The 3/5 Solution

Once again we see the shock and horror that a black man has been murdered in broad daylight by someone legally hired and empowered by the state. YAWN.

Once again we hear the calls for peace and tranquility. Calls for “law and order”. Calls for patience . The questioning of “How did we come to this?” YAWN

The US did not “come to this”. This is who we are. As a nation. Our holy and worshiped founding fathers made it clear in the Constitution. Black men and women are 3/5th of a person. It was true then, it is true now.

Article 1, section 2 … Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons

Of course “all other persons” were the slaves. So the southern states could claim the black men, women and children were property. And then claim that those very same men , women and children must be counted as 3/5 of a person for purposes of representation in the House of Representatives.

So, at the outset of the Civil War almost 4,000,000 slaves added 2,400,000 “persons” to the total population of the slave states. Giving the slave states representation in Congress far beyond the actual number of “citizens”.

From day one black people in the United States have been considered less than “full” people. And that is the bare truth of the foundations of this nation. Like it or not.

So, when the KKK brutalized black Americans after the racists lost the Civil War, it should come as no surprise. And when Jim Crow kept blacks from getting uppity in the south, that should come as no surprise. And when black soldiers returning from WW2 were refused service at restaurants and denied the right to vote, that should come as no surprise.

What should be surprising is the strength of the myth. The myth that the US was founded on principles of freedom, democracy, blah,blah,blah. That has never been and never was the reality. It was and is “fake news”.

Now, you may say, but what about the Voting Rights Act and other Civil Rights acts? Don’t they show progress? To that I respond thusly.

If the US was founded and grew on principles of equality, why was there a need for a Voting Rights Act? Or special Civil Rights acts? Why did we need special laws for black men and women just to try to give them the same rights the rest of society enjoys? In the “land of the free” why was it necessary to write special laws giving “freedom” to citizens who should have already had it?

And, as we have seen, the Supreme Court has overturned even those laws. Since the Voting Rights Act was rescinded how many states immediately took steps to suppress and deny votes to black citizens? How many blacks were purged illegally from the voting rolls in Florida in 2000, giving the election to GW Bush? How many were purged in North Carolina and Georgia in 2016?

But the myth lives on. It is a nice myth. A comfortable myth. A myth that tries to place the suppression and murder of black Americans in a certain context. That context is this: The murder and suppression of blacks in the US is an aberration. A blip on the screen of democracy. A pimple on the otherwise perfect face of equality.

I disagree. Racism has been at the core of the American experience. The very core of the legal system. It is as old as the US Constitution and may never be erased. Racism is as American as violence. Both go hand in hand.

It is not just the south. In the north as well racism is a core value. Highways were built around cities effectively cutting off black neighborhoods from white ones. The attempt at segregation was halted by the practices of the banking industry. Schools in NY, for example, are among the most highly segregated in the nation.

So, let’s stop pretending. The 3/5 solution is still with us. Black men and women are not valued unless they can sing or bounce a basketball. Racism is not a southern phenomenon or an aberration. It is what America was founded on.

Is there a “solution”? There can be no solution when those in power do not see a problem. Or identify the problem as a “black” problem. Just another example of “uppity” Negroes not knowing their place. It has always been thus in America and I suspect may always be so.

I know if I were a black person in America I would go nowhere without being armed. I would suspect every police officer of being a potential killer. I would shoot first and ask questions later. I would know, not just claim, that my life is in danger every day. In fact, I remain amazed at the patience and willingness of most black Americans to work “within the system” when the system is so obviously corrupt. I would not have that patience.

Is there a “solution’? Not until we confront and destroy the myth. The myth of the “founding fathers” and the myth of “democracy” and the myth of “equal justice under the law”.

People die easy. A bullet . A knee to the neck. A chokehold. Myths are not so easy to kill. The 3/5 solution is on display every day.

Business as Usual, the Death Penalty

Business as usual, part 1.

A black guy in Minnesota is suspected of passing a counterfeit $20 bill. Did he do it? Who knows? Did he KNOWINGLY pass a bad bill? Who knows?At any rate he was tracked down and arrested. Handcuffed. Unarmed. Did not resist arrest. Walked off quietly with cops to their patrol car. Was placed on the ground, handcuffed and helpless and murdered. A man put his knee with full body weight on his neck as he plead for his life. Four cops watch him die. Business as usual.

A black kid is walking home in his own neighborhood in Florida. Eating his Skittles. Unarmed. Minding his own business. A guy follows him. A guy stalks him. The guy who is following him feels his life is in danger . So he continues to follow him. They clash. The unarmed black kid is shot to death. The jury acquits. Business as usual.

A black man on the East coast is selling cigarettes. Illegal. You can’t sell cigarettes on the street. The police come to get him. Drag him to the ground. Choke him. He pleads for his life. They kill him. They watch him die. Business as usual.

A little black boy in Cleveland is playing in the park outside his home. He is playing cops and robbers. He has a toy gun. The police pull up in a car. Start shooting. Kill him. His sister tries to get to him to comfort him. The police keep her away. They stand around and watch him bleed to death. Business as usual.

A black man is jogging on a public street in Georgia. He is hunted down by 3 white men and shot to death. The local police and district attorney find no reason to charge these men with a crime. He might have been a criminal. Maybe. Business as usual.

The murder of black citizens is not surprising. It is business as usual.

Business as usual, part 2. Imagine this. I bet you can’t.

A white woman is suspected of passing a bad $20 bill. The police arrest her and kneel on her neck. Killing her.

A white kid is walking in his own neighborhood. A black man feels threatened so he kills him. The black man is acquitted by the jury.

A white man is selling cigarettes illegally. Four black policemen drag him to the ground and choke him to death.

A little white boy is playing cops and robbers in the park near his home. A police car with a black cop pulls up and shoots the boy, killing him.

A white woman is jogging down the street. Three black men think she is a possible burglar. They kill her.

Can you imagine? The death penalty.

Passing a $20 bill. Walking in your own neighborhood. Selling cigarettes. Playing in your park. Jogging.

If you are black, those activities will get you the death penalty. Business as usual.

It was February. A 25 year old man named Ahmaud Arbery was jogging down the street in Brunswick,  Georgia, USA.

He wasn’t bothering anyone. He jogged regularly. Trying to stay in shape. Minding his own business.

The McMichael boys thought he looked suspicious.  Gregory McMichael  thought the man looked like a burglar. There had been burglaries in the area and this guy might be the guy who was doing it. That is why he was jogging in broad daylight . Where anyone could easily identify him.

Gregory is 64. His son, Travis, is 34. They didn’t call the police. They decided that with their shotgun and hand gun they could solve the problem themselves.

So, they go in their truck and tracked down the suspicious jogger. The truck that displayed the famous “Don’t Tread  On Me” flag. True patriots. The jogger who was running on a public street. In the middle of the day. The jogger who just might be a burglar. Might be. You never know.

So the McMichael’s (and maybe an unidentified 3rd person) got in their pickup. And chased down the jogger. They stopped their truck in the middle of the street and waited for him. They confronted him. They pointed a shotgun at him.

He tried to take the shotgun away. Something happened. He was shot. Twice. He died.

Gregory McMichael told the police what happened. The jogger was suspicious. Maybe he was a burglar. We told him to stop and he wouldn’t stop.

Gregory McMichael is a retired police officer. His son, Travis , had a 9 mm pistol stolen on January 1. The gun was left sitting in his truck . He parked it on the street and forgot to lock it. Someone took it. No one knew who. That was the only burglary reported in the area in January or February.

The jogger, a 25 year old former high school football player, was seen jogging. In the middle of the day. On a public street. The McMichael’s decided he may have been the burglar. They decided it was their right to pull weapons on him and stop him. A citizen’s arrest.

No charges were filed against the former police officer or his son. No charges. They had acted reasonably. They had the right to pull weapons on a citizen jogging down the street. The killing of Ahmaud Arbery was justified.

The prosecutor in the case, a family friend who recused himself wrote that the murder was justified. George Barnhill, was ok with the killing. ……“It appears their intent was to stop and hold this criminal suspect until law enforcement arrived. Under Georgia Law, this is perfectly legal,” Barnhill wrote of the McMichaels.

The unarmed jogger who was murdered, it might be noted, was black. And he had been arrested once, as a 19 year old, for possession of a weapon. But the McMichael’s would not have known that. End of story. JWB. Jogging While Black. Add that to DWB  (Driving While Black), BMWB (Being Male While Black) and EWB (Existing While Black). All crimes which justify civilian executions.

Not the end of the story. Months after the cold blooded murder of a black man by the son of a white police officer a video surfaced. Three months after the murder.  A video even Georgia justice could not ignore.

So, now people in Georgia are demanding justice. A grand jury is finally being impaneled. A new prosecutor has the case. But only after three months. And after the tape of the murder somehow emerged. We shall see. Don’t get your hopes up. Remember Trayvon, the boy who was murdered in Florida?  If you are a betting man, don’t bet on justice.

If you are a black man, don’t bet your life. Not in the south. Not if you are black. Stay home. Your life is in danger. Not because of the corona virus, but just because you are black.

The Retrial of Benjamin Forsythe

Benjamin Forsythe wants a new trial.

In 2017 he was accused, and later convicted, of shoplifting. The prosecution claims he had hidden some dog toys … yes, DOG TOYS … in his girlfriend’s purse. Then they left the store without paying.

Well, they did have SOME evidence against him, to be sure. They never actually found the toys in his girlfriend’s purse. BUT. They had a video of him going to the car and bringing his girlfriend’s purse into the store. They had some empty dog toy shelves. Stuff like that.

To be clear, they didn’t catch him in the act. It was only a day later when some store employers noticed some empty packaging in the dog toy department that they investigated. Sure enough, the Sherlock-type sleuths discovered that his girlfriend had absconded with $ 186 worth of dog toys!

Some of you who do not own pets may wonder how anyone could stuff $186 worth of dog toys into a purse unnoticed. I mean, that sounds like a lot of Fido fun. Loads of doggy diversions. Now, those of you WITH pets might have a different view. I mean, where can you get a purse load of dog toys for ONLY $186? Must have been in the discount bin. Give me the address of that store. But I digress.

So, despite his pleas of innocence (his girlfriend took complete responsibility, the sweet thing) he was convicted and sentenced. To 2 to 23 months in jail. For pilfering dog toys. Well, I said he was convicted of shoplifting, but not exactly. Since he, himself, never stole any dog toys he was actually convicted of  “conspiracy to commit retail theft”. YIKES. That’s sounds a lot worse than shoplifting. A conspiracy.

So poor Benjamin was convicted. But that was then. This is now.

After watching hours and hours of the impeachment trial of Donald Trump from his prison cell, Benjamin had second thoughts. The first thought was this. Being  forced to watch hours and hours of the impeachment trial may be grounds for release on a  “cruel and unusual punishment” claim.

Second, he wanted a new trial with Lamar Alexander as foreman of the jury.

You see, Lamar Alexander has stated, in writing,  publicly that  “yes”, the House managers did present a convincing case. In fact, according to Lamar, he is convinced that president Trump DID solicit (extort)  the Ukrainian government to try to force them to present an announcement of an investigation into the Bidens. He had seen enough, but it was not enough to convict.

So Senator Alexander does not need any more proof. Trump is a criminal. The facts are clear. Undisputed.  But, since Trump is a criminal Lamar has decided NOT to vote to remove him from office. Or to seek any more evidence which might even further prove the case already proven by the House managers. Because, after all, if we convicted criminals what would be next? Slippery slope.

Lamar’s statement: “…There is no need for more evidence to prove that the president asked Ukraine to investigate Joe Biden and his son, Hunter; he said this on television on October 3, 2019, and during his July 25, 2019, telephone call with the president of Ukraine. There is no need for more evidence to conclude that the president withheld United States aid, at least in part, to pressure Ukraine to investigate the Bidens; the House managers have proved this with what they call a ‘mountain of overwhelming evidence.’ There is no need to consider further the frivolous second article of impeachment that would remove the president for asserting his constitutional prerogative to protect confidential conversations with his close advisers. 

“It was inappropriate for the president to ask a foreign leader to investigate his political opponent and to withhold United States aid to encourage that investigation. When elected officials inappropriately interfere with such investigations, it undermines the principle of equal justice under the law. But the Constitution does not give the Senate the power to remove the president from office and ban him from this year’s ballot simply for actions that are inappropriate….”

When Benjamin saw this he leaped for joy. That is exactly the point he was trying to make. Just because he was found to have committed a crime does not mean he should be found GUILTY of committing a crime. Just because he was involved in a conspiracy, and that was proven by the prosecution, does not justify a GUILTY verdict. It was not really a crime, it was just “inappropriate” for him to conspire to shoplift. And, if we are to uphold what Senator Alexander calls “the principle of equal justice under the law” shouldn’t Benjamin go free?

Benjamin wants Senator Alexander on his jury. And Dershowitz as his lawyer. Mr Forsythe is hoping to call Donald Trump, Jr as his character witness. If he can afford the fee.

There is a new sheriff in town. His name is Lamar. His concept of the law:   Some crimes are just not punishable. It all depends on who commits them.

The Impeachment of Jeffrey Dahmer

If only Jeffrey Dahmer were still alive. His unjust conviction and sentencing would certainly be overturned. All he needed was a defense team led by Jim Jordan, Congressman from Ohio and Devin Nunes from California.

For those who may not know, Mr Dahmer was convicted of a number of crimes. Murder. Sexual assault. Rape. Necrophilia. But if he had the Republican defense team, and more importantly a Republican jury, he would be a free man today.

The arguments for his conviction would have been something like this. Evidence of his  murder of Steven Hicks consisted of dental evidence, buried in Dahmer’s yard. Evidence of his attempted murder of  Tracy Edward’s by his own testimony (the only victim able to escape). The 57 gallon drum of chemicals in his bed room. And, to quote Wikipedia……

A more detailed search of the apartment, conducted by the Criminal Investigation Bureau, revealed a total of four severed heads in Dahmer’s kitchen. A total of seven skulls—some painted, some bleached—were found in Dahmer’s bedroom and inside a closet.[169] In addition, investigators discovered collected blood drippings upon a tray at the bottom of Dahmer’s refrigerator, plus two human hearts[170] and a portion of arm muscle, each wrapped inside plastic bags upon the shelves. In Dahmer’s freezer, investigators discovered an entire torso, plus a bag of human organs and flesh stuck to the ice at the bottom.[171]

Elsewhere in Apartment 213, investigators discovered two entire skeletons, a pair of severed hands, two severed and preserved penises, a mummified scalp and, in the 57-gallon drum, three further dismembered torsos dissolving in the acid solution. A total of 74 Polaroid pictures detailing the dismemberment of Dahmer’s victims were found.[172] In reference to the recovery of body parts and artifacts at 924 North 25th Street, the chief medical examiner later stated: “It was more like dismantling someone’s museum than an actual crime scene.”[173]

In addition, Dahmer confessed to numerous other murders and crimes, as well.

If this seems like an open and shut case I am afraid you have not seen the Republican defense team at work. So, let’s see what happens when Dahmer calls Jim Jordan to the rescue!!

Mr Jordan: This case is all about hate. Hatred for Jeffrey Dahmer. As soon as the police identified him as a potential murderer they have gone out of their way to convict him. Outrageous! A massive hoax with no fact. All hearsay. The facts twisted to fit their hatred of Dahmer and his kind.

Jordan continues: Let us see what the police actually have presented. All they  have presented are numerous skulls and body parts. Were those body parts and skulls found in Dahmer’s apartment? Yes. So what? Does that prove anything? The only answer is : NO! Is it possible that someone else sneaked  into Dahmer’s apartment and planted that evidence? Just like the OJ frame up? Furthermore, did the police have a search warrant to search for 7 skulls ? NO. they did not. So that evidence should be thrown out of court.

Jordan continues: Now, the prosecution will claim that Dahmer confessed to these crimes when he was caught. But those are only his WORDS. Are we going to convict a man based on his OWN WORDS? My god, what a railroad job. Just because he was able to identify the skulls and tell the police what happened, does that make him guilty? No. Never.

Jordan: Now regarding the so-called “evidence” of the polaroid photos of dismembered bodies. Yes, these were found in Dahmer’s desk. But should they be used as evidence of a crime? Definitely not. These were his PERSONAL photos taken for his own enjoyment. They fall under executive privilege. He classified them as top secret. So no one has the right to look at them. Period. This privilege is perfect.  No one except Dahmer and his lawyers are allowed to see them. Hoax. Hoax. Illegal!!

Jordan: Now, I ask the jury to use their common sense. If Dahmer had killed all these people and used acid to remove the skin from their skulls would he have kept that acid in a 57 gallon tank in his bedroom? If he had buried the bodies would it not be because he wanted to give these strangers a Christian burial? If he did take photos  of mutilated corpses are they not his private property and no one else’s business.

Jordan: This entire case is based on just two pillars. Circumstantial evidence and Dahmer’s own words. No one, absolutely no one, says they witnessed Dahmer kill, mutilate or rape anyone. The prosecution has not been able to produce a single witness to the actual crime. There is no DIRECT testimony. NO DIRECT evidence, only his admission and the skulls.  And the 57 gallon tank. And the body parts in the frig. And the blood. No DIRECT evidence. For that reason, you must acquit.

The Republican jury deliberates for 15 minutes and the returns smiling with a verdict.

Judge: Will the clerk read the verdict?

Clerk: We, the Republican jury find Mr Dahmer NOT GUILTY on all counts……    PS. We also think you should “Lock Her Up”.

At the defense table, high fives all around. Dahmer, in his excitement , invites Jim Jordan to join him for “dinner”. Jordan scampers way quickly and yells back: “Not a chance”.

The Hopeless Sixty Per Cent

A new poll came out from Monmouth University this week.  It reported that 40% of Republicans believe that Mr Trump , in his call to the President of the Ukraine, asked for help in finding dirt on Biden. That means that 60% of Republicans do not believe that Trump asked about Biden. 60%

OK.

This is from the WHITE HOUSE release of the transcript of the call:

“There’s a lot of talk about Biden’s son, that Biden stopped the prosecution and a lot of people want to find out about that so whatever you can do with the Attorney General would be great,” Trump said. “Biden went around bragging that he stopped the prosecution so if you can look into it … It sounds horrible to me.”

So, the White House says that Trump referred to Biden in the call. And asked for an investigation.

The Whistleblower, supported by the Inspector General, was concerned that Trump was making a deal to help himself in 2020 by pressuring the Ukraine to “investigate” the Bidens.

From the Whistleblower complaint:

“…Multiple White House officials with direct knowledge of the call informed me that, after an initial exchange of pleasantries, the President used the remainder of the call to advance his personal interests. Namely, he sought to pressure the Ukrainian leader to take actions to help the President’s 2020 reelection bid. According to the White House officials who had direct knowledge of the call, the President pressured Mr. Zelenskyy to, inter alia:

  • initiate or continue an investigation2 into the activities of former Vice President Joseph Biden and his son, Hunter Biden;….”

 

A number of members of Trump’s staff evidently told this to the whistleblower, which cause d him to  blow the whistle in the first place.

Various news outlets have been reporting on the story, including the exact words of the transcript.

So, everyone right up through the White House says that, yes, Trump asked the president of the Ukraine to investigate the Bidens. I mean, it is there in black and white.

Yet, despite this, 60% of Republicans do not believe that Trump said what he said. Hopeless. Hopeless. Hopeless.

The Three Drug Dealers

Yesterday a major drug company was held responsible for the opioid epidemic in Oklahoma. The Prosecutors estimated that the pushing of these drugs by the company cost the state of Oklahoma billions of dollars in treatment, lost productivity and future health care costs. The White House last year estimated that the opioid crisis has cost the economy over half a TRILLION dollars.

The Oklahoma court ruled that Johnson and Johnson, the drug company, had to pay Oklahoma $572 million bucks. For a multi-billion dollar problem. J and J is appealing the judgment. No one went to jail.

The payment, of course, will come out of the investor’s profits. So, in effect, J and J made billions of dollars, paid a relatively small fine charged to their investors and walks away with no jail time. For a major drug dealer.

Today, in my local area there are other drug dealers being dealt with.

Warren Greenough, age 47,  was stopped for a traffic violation. They found drugs in his car. To be exact. 2.5 grams of crack cocaine….from the article…..

…”Greenough was charged with third-degree criminal possession of a controlled substance with intent to sell, a Class B felony; fifth-degree criminal possession of a controlled substance due to weight, a Class D felony; and third-degree aggravated unlicensed operation of a motor vehicle.

Greenough was later arraigned at Livingston County Centralized Arraignment Part at Livingston County Jail before Village of Dansville Justice Scott Kenney, who remanded Greenough to the custody of the Sheriff on $1,500 cash bail or $3,000 bond. The Livingston County District Attorney’s Office had requested $3,000 bail or $6,000 bond….”

Same day, another drug dealer…..

The Ontario County Sheriff’s Office says 29-year-old James J. Murray of Clifton Springs was arrested for criminal possession of a controlled substance on Tuesday by the county’s Special Investigations Unit. The arrest came after a search was executed by investigators and the OCSO SWAT Team on Murray’s current residence in Manchester. 

During the search, officers found heroin, marijuana, drug paraphernalia, and an unloaded handgun.

Murray was arraigned at Ontario County CAP and bail was set at $2,500 cash or $5,000 bond. Additional charges are pending and will be presented to the grand jury….”

This guy had a full SWAT team!

I suspect that nether Greenough or Murray will be able to pass on the costs of their criminal activity on to their shareholders. But then again, they aren’t incorporated.

Here on Pedophile Isle

The locals called it Pedophile Island. Yet for over 30 years no one associated with Epstein had any clue that he was engaged in pedophilia. All these highly successful, intelligent icons of law, politics and industry and they all were fooled !It was a BIG SURPRISE !!!

And Florida cops wanted to put him away

A few charges were dropped and Acosta was bought

So he managed to slither away.

 

Now all of a sudden all the guys he knew

Deny they ever saw his face

Thoughts and Prayers Template

OK. So, in El Paso, Texas a white supremacist used a military style weapon to kill 20 people and send more to the hospital. In Dayton, Ohio only 9 were killed by a gunman. So, what day is? Another day in America.

At this point we don’t know much about the Dayton shooter. But odds are that the El Paso guy drove for about 8 hours for the express purpose of protecting the fatherland from the Hispanic invasion. Have no clue as to where he got the idea that there was some invasion. Who could have inspired such blind hatred? Where did he get this from?

And, as usual, members of the Democratic (aka Socialist) Party called for stricter controls on guns. In fact, they passed a background check bill in the House which now sits on Moscow Mitch’s In box…also called the “waste basket”. The Dems have this odd idea that if nutcases could not get their hands on weapons of mass destruction there would be fewer mass shootings. Fewer children murdered in cold blood. What kind of logic is that?

And, as usual the members of Trump’s GOP have offered their thoughts and prayers to the families of the victims. Ted Cruz. Moscow Mitch. Donald himself. The entire crew is really broken up over this one. They are very sad. Sad. Very sad.

But the GOP has a problem. Over 100 mass killings already this year. How do you keep your sadness fresh? How do you keep track of the devastation of human life while maintaining your support for domestic terrorists? How do you maintain the facade of concern? Not an easy task.

Which is why I am here. To help. Like usual.

I am offering the GOP members of Congress a simple template for grief. Even they should be able to  fill in the blanks. Or have a staff member do it. Just fill in the blanks, print and you are ready for the camera. Roll em.

My fellow Americans. I recoil in horror at the senseless murders of (fill in a number) our fellow Americans. The sacred place (fill in name of school church, synagogue, mosque or mall) has been forever blackened by this evil deed. My thoughts and prayers are with the people of Texas (fill in a different state if appropriate, although you can figure it is probably Texas). My wife (add name of wife, not girlfriend, be careful here)and I both kneel and pray to God for the victims and first responders. Today (fill in date) will forever be a black day in US history. We must combat this evil by prosecuting the offender to full extent of the law. That will make the families of the dead (fill in men, women and or children) feel much better about their loss. Let us hope we never have to go through such a traumatic event again. May God bless you and God bless the NRA.”

What Were You Thinking?

In his testimony about the Mueller Report, Attorney General William Barr explained his reasons for thinking it is not possible to charge Mr Trump with a crime. The key reason being that the prosecutor would not be able to demonstrate “intent”. According to Mr Barr the only way to charge an individual with a crime is if you can prove an “intent” to commit a crime. Even if the person’s own words suggest intent, unless he is explicit that he wants to commit a crime, there can be no trial. Therefore, no indictment is even possible.

This news reached the prisons and defense lawyers around the nation and they responded with glee. Parties were held. Fireworks were set off on Riker’s Island. The fix was in.  No intent, no crime.

So, let’s imagine for a moment that Attorney General Barr, once he is ousted from his current role, becomes a trial judge. Defense attorneys are lining up to have their cases heard before the learned justice.

Case # 1. Johnny Dillinger

Prosecutor: Your honor, the state will show that Mr Dillinger planned and implemented a number of bank robberies. He used the “Lamm technique” of casing a bank, planning a getaway route and then robbing said bank. He was successful and was found with the money. Other members of his gang have admitted to helping him rob banks. The evidence is overwhelming.

Counsel for the Defense: Your honor, the defense admits that Mr Dillinger did plan and execute said robberies. However, it is up to the state to prove “intent”. There is no proof that Mr Dillinger even knew that taking money from a bank was a crime. I mean, he’s not a lawyer familiar with the intricacies of the law. Furthermore, the “intent” of his actions was not to commit a crime, only to obtain money. Money all of us need to live. He saw the bank and thought that the money in the bank would assist him in providing for his family. If robbing banks was not against the law, no crime would have been committed. My client never, in his wildest imagination , “intended” to commit a crime. He only wanted money. Just like everyone else. I move for immediate dismissal of all charges for lack of evidence of “intent”.

Judge Barr: Well argued . The court agrees that while Mr Dillinger may have committed these “crimes”, there is no way to determine whether he “intended” to commit crimes or just wanted money for his family. Case dismissed.

Case #2: Ted Bundy

Prosecutor: Your honor, the state will prove that Mr Ted Bundy committed at least 30 homicides between 1974 and 1978. Included are charges of multiple rapes, kidnapping and necrophilia. He is a serial killer who is the most brutal sociopath and should never again be released to society. . We have the forensic evidence . We will prove beyond a reasonable doubt that he is guilty.

Counsel for the Defense: Your honor, the defense admits that Mr Bundy did, in fact, take some of the actions noted by the state. We ask you to consider, however, the “intent” of Mr Bundy. Did he kidnap? Yes. Did he rape? Yes. Did he murder? Yes. But what is the real question? In our mind the ONLY question is this: Did Mr Bundy “intend” to break the law?

When Mr Bundy was kidnapping and raping and murdering was he “intending” to break the law? Or was he just intending to rape ? And kidnap? And murder? If rape and murder were not against the law would Mr Bundy even be subjected to this trial? Nowhere in the state’s case does it prove that Mr Bundy “intended ” to break any laws. Just the opposite. He wanted to follow the law, but his sociopathic desires would not allow him to. In his mind, he “intended ” to do whatever was legal. So, your honor, we are requesting an immediate dismissal of the charges based on the fact that no criminal “intent” was proved by the state.

Judge Barr: Excellent legal analysis. While it is clear that Mr Bundy murdered and raped over 30 individuals, the state did not provide any evidence that Mr Bundy intended to break the law. With this lack of intent I am disturbed that the prosecution has even brought the case against this honorable man. Complete exoneration. Case dismissed .

Case #3: LeRoy Jones

Prosecutor: You honor, Mr Jones was found with 2 bottles of baby formula in his possession , not paid for in the grocery store. This is a misdemeanor and we suggest 2 weeks in jail and a $100 fine.

Counsel for the Defense: We concur with the prosecution and plead guilty.

Judge Barr: Outrageous conduct. Stealing is a major crime. Not only did he take baby formula, he obviously intended to break the law. The days of coddling criminals are over. I sentence the criminal to 1 year in prison and a $1000 fine.  Let that be a lesson to all who would “intend” to break the law.

Upcoming Assassinations

The bad news is that political violence is on the upswing. And there is a very good chance of a political assassination.

The good news is that I am wrong more often than I am right.

That said, an assassination seems inevitable.  Violence by white supremacists is becoming more and more common. According to the ADL anti-Semitic attacks doubled in 2018. Right wing nutjobs have used AR-15s to attack synagogues, churches, mosques.

We saw Nazis marching in Charlottesville chanting Nazi slogans: “The Jews Will Not Replace Us” and “Blood and Soil”. We saw the president of the US refuse to condemn Nazis. We heard him say that there were “good people” involved in those chants. I guess he meant “good Nazis”.  That laid out a clear signal to the far right. Violence was acceptable.

At his rallies Mr Trump called for people to be thrown out. He would pay for the defense of anyone who threw out hecklers . If they got violent he would pay their court costs.(Of course he would never pay a debt and wasn’t about to start now, ask Matt Heimbach. He was a Trumpster who was arrested for violence and tried to get Trump to foot the bill. Nice try, sucker).

Talking to New York police, Trump said they should rough up any suspects when they arrested them . Yep. Suspects. Just bang their head on the car when throwing them in the back seat. Rough em up. No trial needed. Violence against a citizen in custody is ok.

The rhetoric coming out of Mr Trump only encourages political violence.

More recently he called the investigation into his corruption an attempted “coup”. Of course, Mueller not only itemized 10 specific instances of obstruction of justice, he also provided information to other jurisdictions to investigate Trump’s financial shenanigans. That was too much for Donald. So, he called legitimate investigations a “coup”. For the record, a “coup” is a violent overthrow of a legitimate leader. By calling this a “coup” he sends a message to his followers that violence is being done to him. He must be defended with violence.

Just last week at a rally he told his supporters that the Democrats supported infanticide. They support killing little infants. Killing babies. He explained quite graphically how a baby is born, picked up and wrapped up nicely, and then a doctor and woman decide to murder it. Should we kill it? Yes, let’s kill it! His Wisconsin followers applauded in approval. Those fools actually believe him. Or pretend to. Which is worse. How can you stop baby killers? Only one way. Kill the killers. Justified. Noble, even.

Since his campaign, aided and abetted by Putin, began in late 2015, Mr Trump has appealed to the most vile and violent elements of society. As more and more of his own crimes are exposed he becomes more and more strident and more and more unhinged. His words call for violence. Sometimes indirectly. Sometimes directly.

This goes beyond the “dirty tricks ” the GOP excels at. As the recent attempt by two Trump dirty tricksters to frame Pete Buttigieg as a rapist. Which was exposed just this week. We know more dirty ticks will follow. That has been part of the GOP playbook since Ronald Reagan and his imaginary “welfare queen” . It’s stock and trade GOP lying.

But the Trump supporters, at least the most wacked out ones, go well beyond dirty tricks. They will do violence. The Coast Guard lieutenant, Christopher Hasson, had a stockpile of weapons and a hit list of politicians to kill. All Democrats. .Presidential candidates. He did web searches to hunt “liberals”. While even Fox News (yes, that Fox News) referred to him as a “domestic terrorist”, the Barr Department of Justice refused to charge him with potential acts of terror. As a result he was allowed to go free pending trial.  What message is this sending to other right wing nut jobs?

No condemnation of violence by the president. No appeals to work together or turn down the rhetoric. No calls for observance of the law. Only calling FBI agents “scum”. Purges of the Justice Department.

Democrats running for office WILL be shot. Maybe killed. It is inevitable.

Guns are easy to get. Nutjobs are easy to influence. Mr Trump has said over and over that the Dems are out to get him. They kill babies. They tried to overthrow him in a “coup”. They are “enemies of the people”, like the New York Times. They are out to destroy our leader. How can they be stopped?

It is a very small step for a radicalized supporter to figure out the message. Kill them before they kill our leader. Kill them before they kill more babies. Kill. Protect the fuhrer. His enemies must die.

I do hope I am wrong but it seems inevitable. Democrats running for office will be shot. And Trump will remain silent. The silence of approval.

Paul, Here’s the Good News

Mr Manafort. A call from 1600 Pennsylvania Avenue:

Hi Paul. How are you doing today?  Got some real good news for you.  Looking good. Oh, still in the wheelchair? Sad. Very sad.

I can’t figure out why they put you in the slammer. 10 years of bilking the taxpayers? Big deal. Hiding millions in income to avoid paying your fair share of taxes? Come on, who doesn’t do that? I have been bilking the suckers for 40 years.

I feel bad for you. After all, if you had never worked on my campaign you might have never been caught. Seems to happen to a lot of folks who worked for me. A lot of my buddies seem to be in legal trouble. Wonder why? Just doing what I asked them to do. Was that wrong? Go figure.

So, one judge gave you only 3 and a half years. Not bad, big fella. Not bad. And this other judge only gave you 3 and a half more. Not a bad deal.

I mean, who wouldn’t trade a lifetime of cheating people and living  like a millionaire for a few years in the pokey at a country club prison? It’s not like you sold a couple ounces of marijuana. Now that will get you put away for a long time. You only cheated your fellow citizens.

Guess what , Paul. I have more real good news for you. Circle this date on your calendar. November 15, 2020.  And hang in there. You see, by then the election will be over. I will be free to start handing out pardons. And you kept your mouth shut. Just keep clammed up. Like a good soldier. Not a “rat” like Cohen.

On November 16, 2020 you will hop out (I presume you won’t need that wheelchair any longer) of the pen and into freedom. A full pardon, pardner.

Now, isn’t that good news?

Just saw a report on Fox and Fiends that you have been indicted for state crimes in New York. No problem. I will pardon those…what ? oh? Jared just told me I can’t pardon state crimes. BUMMER!  Wait a sec…uh, really? Can’t even pardon myself for state crimes? That don’t seem fair.

What good is being the top boss if you can’t pardon yourself? No collusion. No collusion.

Hey, Paul, you don’t think that the NY attorneys will go after my little business in the city, do you? Like my real estate deals? My Russia money connections? My “creative accounting” on my taxes.  That would be bad news.

Sorry, Paul, looks like a pardon won’t do the trick for you. Or me. Unless…. Jared has an idea.

We can get Donald Junior to run for governor of New York. If he wins, which he will since he is a Trump. Then he can pardon all of us. I better start working on that right now. No time to lose.

Pardoning Oswald

Today Mr Trump pardoned “Scooter” Libby for his crimes against the US government. Just as he pardoned Joe Arpaio for his crimes against the US government. Seems like Mr Trump has a soft spot in his heart for certain kinds of criminals.

What did the “scooter” do? Well. Background.

In the build up to the Iraq invasion the Bush-Cheney White House put out the narrative that Saddam had an active nuclear program. So active, in fact, that he had acquired “yellowcake” uranium from Africa. Hence, the need to attack ASAP to prevent him from building the “bomb” !!

Concerned about this revelation (and knowing nothing about it) the CIA sent Joe Wilson to Niger to investigate. For 8 days. He found that the claim was false. Not only that, he wrote an op-ed to that effect. Congress had been given twisted information in the run up to the war. They voted for a war based on lies.

Not long after that a conservative pundit, Novak, published the name of Valerie Plame announcing to the world that she was a CIA operative. He got this information from 2 Bush administration sources, one of whom was the “Scooter”, a Cheney staffer. Why would the White House leak the name of a CIA operative? And why would a journalist publish her name? To what purpose? How does this help anyone?

It turns out that Plame was the wife of Joe Wilson. So, her career with the CIA was over. More important, her informants  in Europe, where she had been working under cover, were now at risk. Anyone associated with her might now be at risk. Who was feeding her information? We will never know how many lives were effected. And how many potential informants now would hesitate to deal with the CIA in fear of eventually being found out.

So, that was “Scooter’s” crime. The outing of a CIA agent for no other purpose than payback for her husband telling the truth. GW Bush REFUSED to pardon him, although he commuted his sentence.

So, why pardon “Scooter” now?

Some possible reasons. To send a message. Anyone who lies to the FBI in support of Trump has been given a clear signal…I will pardon you. Don’t worry. Keep the faith. Hold the line. Stick with the boss. Take the heat for the godfather.

Another possible reason? Distraction. Comey’s book came out today. And his interviews. And Trump is shitting himself. He has to distract. Give Hannity something to talk about? Distract from the Cohen raid. Distract form the Mueller probe.

Or, maybe Donald simply has a soft spot for criminals. White criminals. White collar criminals. Criminals he can relate to. Which leads me to conclude we will see even more pardons as the days progress and Mueller gets closer and closer to Donalds’ financial shenanigans.

I predict the following pardons from the Nuremberg trials. So many were falsely accused !!!:

April: Oswald Kaduk. Guilty of crimes against humanity. Auschwitz Trial; Karl Seufert. Guilty of crimes against humanity. Auschwitz Trial; Emil Bednarek.  Guilty of crimes against humanity. Auschwitz Trial

May: Bruno Schlange. Guilty of crimes against humanity. Auschwitz Trial; Lutz Graf Schwein von Grosigk. Guilty. Ministeries Trial.; Max Otto Ihn, Guilty, Krupp Trial.

June: Ernst Biberstein. Guilty. Einsatzgruppen Trial; Carl Krok. Guilty. IG Farben Trial; Carl Genzken. Guilty. Doctors Trial.

Everybody Run, Teacher’s Got a Gun

We live in the age of iodiotic ideas followed by even more idiotic ideas. Most of the “solutions” to problems seem to be designed to create even more problems. And they do. Inevitable.

The latest idiotic idea is that we should start arming teachers in our schools. The NRA supports this idea, of course. As the primary gun manufacturing lobby this will mean more sales. More sales means more dollars to legal gun runners. More dollars to legal gun runners means more dollars in the NRA account. So, the idiotic idea at least has an upside for someone.

As I taught school for 33 years I wondered how I would do if I were armed. Nothing big. Just a small sidearm. A six-shooter. At my hip. Ready to go. Bang. Bang. You’re dead.

It would have proven a useful tool in my arsenal of teaching tricks, to be sure. Before I go on you might consider this. A number of studies have placed teaching as the third or fourth most stressful job in industrialized societies. Third or fourth. Behind soldiers. Cops. EMTS/medical folks. Lots of stress. And not so good on the wages for all those professions. So, even more stress.

Back to my gun.

I can think of some situations in my long career where a gun may have been useful. And remember the old saying: Don’t point a loaded gun at anyone unless you intend to use it. Use it I would.

There was the 7th grader I will call “Billy Bob”. Billy Bob never did his homework. He almost always sauntered into class late. He shot spitballs on a regular basis. Never passed a test or quiz. Sometimes spit on the floor. He was sent to the office so often he earned frequent flyer miles. And he had a smart mouth. “You’re not my father, you can’t make me do nuthin”.  Wonder what I would have done with a loaded gun?

Then there was Akili . The 18 year old in 9th grade. Came to class once in awhile. Never had a book. Never had a pen or pencil. Never would answer a question. I asked the administration what to do with this kid. Why was he even in school? The answer? He had a “right” to an education and it was my job to teach him. Also, he is selling drugs but we can never catch him. So, once in awhile Akili would show up and take up space. Sit and smirk. Eventually Akili disappeared. Word has it he was “offed” by a rival in the drug business. Still, I wonder? If I had a gun would I have beaten his rival to the punch?

Then there is the monthly faculty meeting. Wherein a person who taught for 3 years and then decided he wanted to make real money but had no skills went on to get an “administrative degree”. This degree allowed such a person to be hired as a principal or vice principal of a school. And to supervise people who actually knew something about educating kids.

Now, this person would hold a faculty meeting. Usually the meeting was designed to inform teachers that they were responsible fo passing all the students. Especially those that did no work. I had one administrator tell me I should never give a grade lower than a 60 on any assignment, even if the student did not turn it in. Not hand it in. Give him an automatic 60. Really. That was his policy. Which I ignored, of course.

Also at the faculty meeting the room full of teachers will be told they must attend “teacher workshops”. Now, a teacher workshop is a place where teachers with 20 years experience sit in student desks and listen to a 23 year old who has never been in a classroom explain how to do the job better. How to inspire every student. How to write individual lesson plans . All 150 of them. Every day. Imagine a room full of armed teachers, after correcting 150 essays, most of which were downloaded from the internet, being told how to do their jobs. Locked and loaded. Yes, give me a gun. Please. Let’s get his meeting started.

Of course there is the dreaded  hall duty. Stop a youngster in the hall who seems to be wandering around aimlessly. Might be lost. Might be looking to bust open a locker. Who knows. So, I ask him very politely: Do you have a hall pass? Where do you belong?

He answers: “Who do you think you are? None of your business. Nobody tells me what to do. Cram it asshole”

Yes, give me a loaded gun.

Now, don’t get me wrong. These are isolated cases and I could give you plenty more. They only happen once in awhile. I might be having a great day and then…bam…some kid destroys it. And, like Rex Harrison in My Fair Lady, ” I’m a very gentle man…

But some of my colleagues? Nope. They have neither my unending patient nor ability to digest bullshit, from all quarters, above and below.  Arming any of them would put all of us at risk. Every day.

An idiotic idea. Arming teachers. I can see it now. Take Mrs. Nicklebumpkins 9th grade Algebra class. She just can’t take it anymore. And we all understand why.

Shots ring out. Students running down the hall from her class, screaming in terror…

More Donuts, Please

There is an epidemic of gun violence in America. That is not even debatable. And there have been a multitude of solutions offered over time.

Most recently the President of the United States, the NRA and many members of Congress have offered the latest solution. Arm teachers. More armed guards. More guns. And more guns. And more guns.

A creative and exceptionally innovative solution to the problem of gun violence. More guns. So, I said to myself, why stop there. Maybe we can apply that same “reasoning” and “logic” to the many other problems we face. Let’s try.

Obesity is a major problem in the US. Anyone who has ever traveled to Italy or France or Spain immediately notices that there aren’t so many obese folks walking around. It could be limited to urban areas, perhaps. But, at least in my experience, folks in those countries  as a rule, seem not so chunky as Americans. I , myself, have done my patriotic duty by increasing my body mass significantly over the last 50 years or so. A proud American. A BIG proud American.

What is a reasonable solution to the health issues caused by obesity? Well, former First Lady Michelle Obama started a healthy eating program to encourage kids to develop good eating habits at a young age. She was vilified by the right wing extremists for that. Big government interfering with the proper parental role. Then Sarah Palin showed up at an elementary school with cookies for kids. She passed them out. She didn’t bother to ask parents if they wanted their kids to eat cookies or perhaps had allergy issues. The right wing applauded. More cookies. More cookies. More cookies.

So, a reasonable solution to the obesity problem is more donuts. More junk food. Less fruits and vegetables. The problem of obesity can be solved by increasing the availabilty of junk food. Yepper.

Drunk driving kills thousands of Americans each year. Currently we have DUI laws and put folks in prison for that. Take away licenses for driving drunk. But that has not solved the problem.

What we need is more and better access to booze while on the road. Every gas station should have a liquor license. Every driver should be given a free beer with a fill up. End DWI laws and impose DWS laws (Driving While Sober). Pull over anyone who is not weaving side to side at 50 MPH in a school zone. Fine em. Drink or don’t drive. The obvious solution to drunk driving is more access to alcohol by automobile operators. Yepper.

The opioid epidemic. Killing thousands every year. These opioids, many prescribed legally, have wreaked havoc on families and individuals. They have destroyed families. They are agents of death. So, what is the solution?

Easy. We need complete and total access to opioids . No prescription necessary. Over the counter. At the supermarket. The drug store. In our schools. Free opioids with every order of fries at Mc Donald’s. (Solving two problems at once)  The only way to stop the madness is total access to opioids. The more the better. Every teacher should be armed with opioids in case of an emergency. The emergency being that Billy forgot his opioids today. Yepper.

We could go on and on. But the message is clear.

The best way to solve a problem, according to our current leadership, is to make it even bigger.

Words, Part 1

“In the beginning was the word…” so begins the Bible followed by both Christians and Jews.  In Hindu mythology, the word “Om or Aum” is the first sound of creation. The Qu’ran is thought to be the word of Allah by Muslims. Members of the Church of Later Day Saints believe that Joseph Smith of upstate New York was given the words of god on golden tablets.

Words are important. Of all the species still on Earth, it is homo sapiens alone that uses speech to communicate sophisticated ideas. Other animals use sounds to express fear and danger and affection and contentment. Chimps use signs and sounds. Bonobos have been taught to use symbolic language to express complete ideas. Some other primates even use sign language to communicate when hunting in groups. There is something in the DNA of primates that demands communication. We are all social animals.

Words are important.

Primates use body language and words to communicate. The key word is “communicate”. Communication does not necessarily mean that a human or other primate is interested in communicating the truth.

For example, we have evidence that when some Rhesus monkeys see food they call out to others and share it. Once in awhile, however, a monkey will keep quiet or even give a false predator warning cry to distract from the food source. They lie. They communicate something which is false. Then they sneak the food for themselves.

We depend on words. When someone lies to us it becomes very difficult to trust them again. When someone misuses words (that is lies) under oath, we consider them criminals. Even presidents. Bill Clinton was impeached by the Republican Congress for lying.

He was not impeached for having an affair. He was not impeached for any illegal financial dealings. The 4 year long investigation of Bill Clinton and his wife’s finances (Whitewater) found nothing illegal. The Starr investigation after spending mllions of dollars  found no criminal behavior based on the original mandate, which was to look at the Clinton land deals.

Both articles of impeachment against Clinton dealt not with any financial wrongdoing, but the fact that he lied about his sex life when under oath.  You may wonder why the Starr investigation was expanded into his sex life, but that is another matter. A corruption charge was never supported, but his lies about his sex life were considered important enough to expel him from the presidency. So, he was impeached for words he said.

Our current president has , according to the factchecker at the Washington Post, told over 2,000 lies and misstatements in less than his first year in office. Over 2,000 documented examples of intentional miscommunication. Since he is not under oath, none of those lies are actionable under the law. But that degree of miscommunication may be one reason why he has an approval rating below 40% in most polls.

When words are used for miscommunication then the very idea of language becomes damaged. Language is supposed to be a positive force through which we convey ideas and beliefs and emotions in an honest way. When language is exploited regularly to miscommunicate it leads to a general distrust of any communication. When words are used as weapons, rather than tools of honest communication, all language becomes suspect.

We see attacks on the press, attempting to delegitimize the one institution which is based on words. Honest words. ( I deal with this in another post a year ago: https://josephurban.wordpress.com/2017/01/30/lugenpresse-testing-the-waters/)

Politicians, of course, depend completely on words. When they lie by misstatements or omission to intentionally deceive people it is especially disturbing. We see them lie most often when the facts and evidence do not support their assertions. A good example is the reemergence of the supply side economics which failed miserably under Mr Bush. Tax breaks for the wealthy to boost jobs. It just does not happen, but that does not stop the lying.

My own Congressman, Tom Reed, NY 29 is especially adept at the half truth and miscommunication. He miscommunicated not only his own views (as seen by his actions) but impugns his political opponents by lying about their views as well. And he is very good at it. So he gets re-elected.

So, while “sticks and stones may break my bones but words will never hurt me” is true on the playground, it is not true in politics. Words are the core of politics because they are used to convince others to act.

We currently live in an era where those with the most political power are determined to stay in power through miscommunication. Not by the power of their ideas.  Not by the benefits to the people derived by their actions. But by miscommunicating to such an extent that even 2,000 lies a year does not bother them.

Next time I will look at the variety and scope of the miscommunication, the misuse of words, by those currently in power.

Sex Harrassment Training

“The Senate unanimously approved legislation late Thursday that institutes mandatory sexual harassment training for senators and aides — a potentially meaningful shift amid calls for overhauling Capitol Hill’s system for handling harassment complaints.”

I was able to acquire an actual audiotape of the first meeting of the sexual harrassment training for Congress. I have changed the names to protect my congressman.

From the audiotape:

Anonymous Congressman: Hey, babe, is this the place for the sex training?

9 year old girl: Hi Mister, yes, this is the place for your training.

AC: So, who is running this show?

9YO: I am . I was asked by my mommy to talk to you all today.

AC: Aren’t you a little young to teach us how to harrass women?

9YO: No, Mister. I am here to help you learn how to be good.

AC: Oh, oops. I misunderstood. The email  said “sexual harrassment training”. I thought someone would teach me how to  harrass my female  employees and not get caught.

9YO: No, Mister. I am supposed to help you understand that sex stuff is wrong.

AC: Ouch. Boy am I embarrassed. So, what do I need to know?

9YO: Well, you should be nice to people.

AC: But what if I really want to touch a woman. You know, I really want to. I can hardly control myself. And I am the boss.

9YO: You should not touch anyone who doesn’t want to be touched. It’s not nice.

AC: OK. I never knew that ! Wow! So, if I am the boss I should not just like kiss her or grab her by her..uh.. private parts. You know, like President Trump.

9YO: No, that is wrong. That is being a bad man. You should never touch anyone who does not want to be touched.

AC: So, it would be wrong to just grab a woman? Really? I never knew that. What if I say sexy stuff to her? Like Clarence Thomas.

9YO: No. That is bad. You should not say sexy words to someone  in the workplace. You should never say things to make them afraid or sad. That is bad.

AC: Wow. I never knew that. So I should not make commensts to women about having sex with me or force a women to have sex on my desk. Like Matt Lauer.

9YO: NO! That is called rape. That is a bad thing. Do not do that. That is very naughty. Don’t you understand?

AC: What if I “accidently” grab a female on her butt? I mean, what if it is an accident? Like Al Franken?

9YO: NO! You are making me mad ! No. No. No. That is wrong. Don’t touch.

AC: Well, I am trying. But I never knew that was wrong. I am learning so much today that I never knew! Let me see if I understand. I should not touch women or girls  if they don’t want to be touched. I should not say sexy things to women in the workplace. I should not rape women, even if they are working for me?

9YO: Yes. Now you understand. That is called sex harrassment. That is wrong. I learned in Kindergarten that you should not touch others. Didn’t you ever go to Kindergarten? My teacher said to never touch others who do not want to be touched.

AC: OK. I get it. Thank you for this training. I never knew that it was wrong to touch or kiss or rape a woman. This training has really opened my mind.

(The 9 year old leaves the room but the tape is still running.)

AC: (talking to an aide). That girl was really HOT, wasn’t she? I was going to invite her to have dinner with me tonight at Hooters. Think that would be wrong?

Personal aside: The people who we elect to make our laws need to be TRAINED not to sexually harrass other human beings. Please read the previous sentence again. Then try not to cry.

Fitness for High Office

One of the most laughable statements  by politicians in modern times was made by Mitch McConnell recently. He was talking about Roy Moore, the GOP candidate for the Senate.

Let me say this about Roy Moore. He is, in my opinion, a pedophile. He is a slug. He sees himself as an Old Testament patriarch whose gender and age allows him to do anything he wants to anyone he wants. At the same time, the people of Alabama have the right to send to the Senate anyone they want.

If the people of Alabama want an accused pedophile and a moron to represent them, so be it.  If he committed a crime in Alabama that is for Alabama to determine. Look at the man who he is trying to replace. Jeff Sessions. A man who actively prosecuted black citizens for registering other black citizens to vote. The “high standards” of the Senate dd not see a problem with that. The Senateand House have been seating bigots and racists for over a century and it seems not to violate any ethical standards.

How many of these giants of the Senate have voted over and over to take away heath care for the working poor? How many times have they voted to end the ACA? How many times have these morally superior men noto voted t raise the minimum wage for those “working Americans” they love to talk about. How many of these fine gentlemen have voted to give massive breaks to the wealthy and screw the poor? How many of these fine representatives have supported voter suppression laws?

I would suggest that there is NO ONE who is morally repugnant enough to be excluded from the Senate or the House . And the record supports me.

I could care less if a senator wants to bang a dog. In some states that may be a requirement. Who knows?

That said, let’s look at a number of these sexual accusations and how they played out over the years.

Dwight Eisenhower and John F Kennedy both had affairs . The press never reported them although they were gossiped about  and well-known. But affairs are consensual sexual relations. Which are in a different category than sex crimes. (Although when JFK and Ike were alive adultery was a crime in most states, and is still a crime in 21 states. Did Moore commit sex crimes? Seems so. He was in his thirties and went after very young girls. Pedophilia?  His supporters seem to use the Bible as some justification for his proclivities. I think the guy is just sick and needs treatment. He seems to have  along history of this kind of behavior.

Al Franken has just been “outed” as an abuser as well. He forced himself on a woman and kissed her against her will. He took a fraternity-style photo of himself pretending to grope her while she slept. Is this sexual assault? Was this a one time thing ? A jackass trying to be funny? Franken apologized and said he was ashamed. Will other women come forward? If the people of Minnesota want a former comedian who has apologized for his actions to represent them, so be it.

Bill Clinton had consensual sex with Monica Lewinsky in the White House. She was 22 years old. Is a 22-year-old woman an adult who can make those decisions about who to have sex with or not? Is it crass and icky for an old man to use his position of power and have sex with someone who technically works for him (although in a non paid position). Is it illegal or just smelly? Does it make him unworthy to hold the office of president?

Then we come to the Abuser-in-Chief himself. A man who has bragged repeatedly about sexually abusing women. He has said he forced himself on women. Kissed them when he wanted. Grabbed them by the pussy. He has been found guilty of discrimination in housing  against black renters. He has been found guilty of ripping off young people at his phony Trump University and forced to pay $ 25,000,000 in damages. And he has been accused by multiple women and girls of sexual misconduct, including forcible kissing and groping.

How can Mitch McConnell or anyone member of the government DARE claim that Judge Moore or Al Franken or Bojo the One-Eyed Pedophile is not fit for government “service”.The American people have spoken. Well, at least 60,000,000 have spoken.

They spoke in November of 2016 and said unequivocally that ANY PERSON, no matter how low their moral compass is suited to participate at the highest levels of government. No matter what kind of sluggish behavior a human being can engage in, it was evidently not sluggish enough to prevent 60,000,000 from voting for him.

The Congress is not the synod of bishops or the college of cardinals of the Catholic Church. It is not a moral or religious organization. It is a bunch of men and some women who want to tell the rest of us what to do. They want to make laws. They are fallible human beings who should not be held to any standard other than how they vote on issues.

I do not support sex abuse in any form, but let’s be real. The  “standards” of government behavior hardly eleimnate anyone from serving in Congress.

Witness Tampering

I don’t follow Hollywood so I really have never heard of this Weinstein character. I wouldn’t recognize him. I wouldn’t want to. Evidently he spent years harassing, attacking, abusing, maybe raping women who were his subordinates. Evidently a lot of people knew about it and colluded in covering up what he was doing. Payoffs were made. Hush money to victims.

We saw the same thing with Bill O’Reilly and Fox News. Over $13,000,000 paid in hush money. Same with Roger Ailes, also at Fox. Donald Trump even bragged about assaulting women. Who knows how much hush money he has paid over the years. Then there is Cosby. And Bill Clinton.

Who knows how many other men in positions of power have abused women and work for companies that paid hush money. These victims sign “confidentiality agreements”, get paid a lot of money (by the stockholders of these companies) and then are required to keep silent about the abuse. All legal. For some reason.

Which confuses me. Didn’t these men commit crimes? Is it legal for wealthy individuals to exempt themselves from criminal prosecution by paying off witnesses? That seems to be the case.

Imagine this.

A man robs a bank and walks off with $1 million. It turns out that someone in the bank recognized him. So, the bank robber goes to guy who recognized him and says: Here is  $100,000. Sign this “confidentiality agreement” that says you will not turn me in. And if you do turn me in my gang and I will make your life miserable.”

Would that be legal?

Can you make a legal agreement NOT to report a crime in exchange for cash? Especially when not reporting a crime may mean even more people will be victimized and paid off in the future?

I don’t know the law, but it seems to me no different than witness tampering. A criminal paying a witness to keep quiet. The guy with the thicker bankroll walks away. To commit more crimes. And make more payoffs.

Maybe there ought to be a law against all “confidentiality agreements” which involve any illegal activity. Don’t you think?

A Moment of Silence…Then Re-Load

Another American Tragedy has occurred. Every day 100 Americans die due to guns. About half are suicides and accidents. The other half are murders. Every day. A daily American tragedy.

But some days are more tragic than others. Mass shootings. Mass killings. Or a Congressman or Congresswoman shot. Every day it’s somebody’s baby, somebody’s husband, somebody’s daddy, somebody’s mommy. Every day.

But when the mass killings occur the entire nation stops. Stops for a moment of silence. The president sends his condolences. It is part of the job description. The anti-gun lobby energizes and says: This has got to stop. The gun lobby energizes and says: No, it doesn’t.

In this century.

Red Lake Massacre. Minnesota 10 dead, 5 wounded. Moment of silence.

Virginia Tech Massacre. Virginia. 23 dead, 32 wounded. Moment of Silence.

Binghamton shootings. New York. 14 dead, 4 wounded. Moment of Silence.

Fort Hood Massacre. Texas. 13 dead, 30 wounded. Moment of Silence.

Aurora Theater shooting. Colorado. 12 dead, 70 wounded. Moment of Silence.

Newtown School shooting (Sandy Hook) Massachusetts. 28 dead, 2 wounded. Moment of Silence.

Washington Navy Yard shooting. DC. 12 dead, 8 wounded. Moment of Silence.

San Bernadino shooting. California. 14 dead, 21 wounded. Moment of Silence.

Orlando Nightclub Massacre. Florida. 49 dead, 53 wounded. Moment of Silence.

Las Vegas Strip massacre. Nevada. 50+ dead, 500+ wounded. Moment of Silence.

So much silence. So much silence in the face of regular murders. The moment of silence is no longer special. No longer has any meaning.

So, why have a “Moment of Silence” after these disturbing mass killings of Americans by other Americans?

Perhaps it is to give the NRA the time to re-load.

372,000 Heroes and Silence

Congressman Scalise was shot by a nutcase with a gun. The usual nutcase, a white male. He was targeted for his political beliefs by a disgruntled , out of work male and shot. Not killed, but almost.

The same thing happened to Congresswoman Giffords a few years ago. On the other side of the political spectrum. Shot by a disgruntled white male. A nutcase. Like Scalise, she survived.

In both cases Congress rose as one to condemn the senseless violence. In both cases Congress was appalled by the mindless, fanatic attack on one of their own. The Congress pulled together behind Giffords and Scalise. They condemned the violence. They praised the courage of their colleagues in the face of near-death.

Scalise and Giffords are heroes. They survived. They live . Congress is outraged. Congress is sickened. And Congress will do nothing about it. You can take that to the bank.

Since the terror attack on 9/11 over 372,000 Americans have been heroes. You don’t know their names. 372,000 Americans have been injured by guns. Intentionally. 372,000 heroes who have been cocooned in silence as far as Congress is concerned. Not a peep from the outraged. Not a condemnation from the Capitol dome. Nothing.

In addition. Approximately 186,000 Americans have been killed, intentionally, by guns. 186,000 heroes. Silent heroes. Unnamed heroes. They were not important. They were not in Congress.

There have been 62 tragedies of 9/11 proportions since 9/11. Americans terrorizing other Americans with guns. Americans murdering other Americans. Sixty-two 9/11s. From Congress? Silence.

Every day in America, on average, 7 children and teens are killed by guns. Every day. This week there will be 50 Gabby Giffords who do not survive. All of them under the age of 20. Over 5000 children hospitalized each year with gun-related injuries. And Congress is silent.

Every day 93 Americans are killed by guns. Homicide. Accident. Suicide. They are all dead. This year 34,000 Americans will die because someone had a gun. And didn’t keep it safe. Or used it aggressively in during a moment of anger. Or in a temporary fit of depression just took their own life. It is almost equivalent of one 9/11 each month. And Congress is silent.

So, it may seem cold. But I do not get outraged by the shooting of Giffords or Scalise. I don’t applaud the violence. But it leaves me a bit cold.

After all, there were over 66 Steve Scalises  shot today and sent to the hospital. They survived as 66 unnamed heroes. No Congressmen shed tears or made speeches condemning their assailants.  And the 230 Gabby Giffords who were shot this week did NOT survive. 230 dead unnamed heroes. Not a peep from Congress. Not a word. Silence.

When compared to other industrialized nations the US has a homicide rate which is, on average, 25 times higher. The US homicide rate by guns is 18 times greater than France. The gun homicide rate is 60 times higher than Germany. And the US murder rate with guns is a whopping 90 times that of the UK. (Note: These numbers are out of date, but not that far off).

To be fair, Latin American nations like Brazil, Mexico, Colombia, Guatemala, Belize, etc. have significantly higher murder rates that the US. So, I guess that is some consolation. We are better than Honduras. Hurray!

Nothing will change. Scalise will be lionized and applauded for surviving. He lives. But the applause will end. Our representatives  will cry their collective crocodile tears. Then Congress will get back to regular order, which includes taking massive donations from the NRA and the gun industry.  In the last election cycle the NRA and gun industry spent $ 52,000,000 opposing candidates who support gun control.

So the killings will continue. And so will the silence.

The Leopard’s Spots

“Can the Ethiopian change his skin, or the leopard his spots?…”  Jeremiah 13:23

Donald Trump received the votes of 46% of the American people.

Despite his crudeness, vulgarity, arrogance, xenophobic comments and outright lying. So, Donald Trump was approved by millions and millions of mainstream Republicans. The voter that does the lockstep, into the voter booth, pull the lever Republican. There are, undoubtedly, equal numbers of Democratic voters who do the same for any Democratic candidate.

I have to think that many Republicans thought that the Donald Trump Show was just a show. A way to attract attention and get votes. A way to win using any tactic available. Like winning a real estate deal. Or cleverly avoiding paying taxes. Or deflating footballs.

And perhaps these folks thought that once Trump was sworn in as POTUS he would take on a different demeanor. He would naturally come to understand the importance of being president. Of acting presidential. Of bringing people together.

He would ignore the petty insults. Stop tweeting his every thought. Ask professionals to assist in the decision making. In short, once he was elected he would become an adult. Not go off the deep end. Not see every word of opposition as an attack to be repelled and all opponents to be smashed.

In short, perhaps they thought the office would impact the man.

But the leopard, we have seen over the first 3 weeks, does not change his spots. Trump is who he always has been and will continue to be. Abrasive. Ignorant. Crude. Combatative. Thin-skinned. A child.

An adolescent mind in a septuagenarian body. A CEO who is used to everyone kowtowing and telling him how wonderful he is. And if no one else does, Mr Trump will tell you himself. He is every bit as incompetent as we thought.

He writes executive orders without going through the process of determining their legality. He gives no thought to the ramifications of his actions.

If a judge disagrees with him he attacks the judge. Just as he attacked an American judge of Hispanic descent as a “Mexican” because he did not rule in Donald’s  favor. Another court says that, perhaps, the Immigration EO is not Constitutional.  He attacks a judge as a “so-called judge”, impugning the judiciary. Attacking the third, equal branch of the government.

He calls a US senator a liar for quoting  Judge Gorsuch and his concerns about Trump’s attacks on the judicial branch.  Despite the fact that the spokesman for Judge  Gorsuch verified  that the senator was correct. And another GOP senator, Sasser, reiterated the Judge’s concerns, further undermining the veracity of Trump.

Trump demeans the military service of Blumenthal and , just yesterday, of John McCain. Again. Mocking them out, one for serving in the military and not going to Vietnam, the other for being a pilot in a war that the US lost. Losers both. Of course, Trump himself COULD have gone to Vietnam but was given 5 deferments.

Trump makes a public statement that crime is at a 47 year high. Not even close. Does not matter. He simply repeats lies because he wants to. The data (from the FBI) shows that the violent crime rate since the time of Reagan has dropped 40% . To paraphrase Donald, that is a “very big deal, big number, lots of numbers”. Does not matter, Mr Trump says crime is at a 47 year high.

Trump makes a speech about the vilest incarceration and extermination of human beings in the 20th century. The Holocaust. He mentions gays and Gypsies and other who were caught up in the “Make Germany Great Again” hysteria of the Third Reich. But he fails to mention Jews. Is he a Holocaust “denier”, anti-Semitic or just stupid?

Of course, at this point, we have become immune. The man lies so regularly and so pointlessly that we can just assume that 1/3 of what he says is false. I expect that Mr Trump thinks that 65% of the time telling the truth is considered a  passing grade.

He uses the powers of the presidency to help his kids and wife hawk their clothes and jewelry. Openly threatening any company or group that “insults” his flock. He is right at home in this role. Huckster,  Bully. Conman.

What is fast becoming clear is what those of us in the majority have been saying all along. The man is unqualified to be president. He is not INTERESTED in doing the hard work of the presidency.

A president must have a grasp on reality. He must be a quick study or at least attempt to study. He must have more than a National Enquirer  (a rag that Trump has quoted as a source ) understanding of the world. He must be open to new ideas and open to science. It is HARD WORK. That is why presidents go grey.

Trump is not going to change. He wanted to WIN an election. He never has shown any inclination to serve the people. Never any curiosity, however minuscule, about the real world. He is a conman who is not going to change now. He doesn’t want to put in the effort. He shies away from anything close to hard work or intellectual activity.

Perhaps that is why Steve Bannon seems to be the one really in charge.

Good News is No News

It seems as though the news emphasizes almost nothing but catastrophe and encourages negativity. This is not new, but it seems to be overwhelming sometimes. And it leaves the impression that we live in a constant state of terror, unhappiness, fear and anger. Things are getting worse and worse. Danger around every corner. The end is near! That is the narrative.

Good news does not sell papers or drive “clicks”. Good news is boring.

Some good news.

Hiding Under the Bed

I have been reading a lot of history lately. The biography of John Adams. The biography of Alexander Hamilton. The story of the b-17 bombing of the Nazis during WW2.

Americans of the distant and recent past put their lives on the line. Whether they were right or wrong can be debated. Was Vietnam worth it? Was Afghanistan necessary? Was Iraq a proper response to 9/11?

Whatever your political philosophy it seems as though Americans have always stood up and faced whatever “evil” they needed to face. Even if some of that “evil” may be imaginary.

Until recently.

Over the last few years we have seen a new American emerge. This is the American of the political right wing. Just as American as you or I.  But Americans who have redefined what it means to be a “patriot” or a “citizen”

These Americans, unlike their forefathers, live in a state of constant fear. They are constantly horrified. Perpetually frightened.

They reject  the liberal FDR who, when faced with the most devastating economic disaster the US had ever known, responded by telling Americans, in his first inaugural address. “The only thing we have to fear is  fear itself”. A statement FDR repeated in 1941 in response to the Nazi menace.

They reject the words of another liberal president, JFK, who pronounced, “Let us never negotiate out of fear, but let us never fear to negotiate”.

We might even try Ronald Reagan, the patron saint of the GOP, who said, ” Whatever else history may say about me when I’m gone, I hope it will record that I appealed to your best hopes, not your worst fears; to your confidence rather than your doubts.”

Well. Not so.

Today, the entire right wing seems to be hiding under their beds, teeth chattering. To hear some of these new Americans talk you would think we are a nation of cry babies and cowards.

What are they afraid of?

Gays.

Transgender people using bathrooms.

Gays getting married.

People who want to take away their guns.

People without guns.

Women who want to control their own bodies.

Blacks.

Blacks voting.

Old people voting.

Anyone voting.

The government.

Muslims.

Foreigners.

Mexicans.

Atheists.

Teachers.

Gays in the military.

Black Lives Matter.

Communists .

Socialists.

Libtards.

Did I mention gays?

Perhaps we need to get these grown men out from under the beds. Be gentle with them. Pat them on their heads. Hold their hands. Tell them it will all be okay. Nobody is going to hurt them. No gays are going to attack them. No one is taking away their guns. Heat up some cocoa and give them a cookie.

The poor darlings are frightened out of their (half)wits.

Perhaps Plato said it best over 2,000 years ago.

“We can easily forgive a child who is afraid of the dark; the real tragedy of life is when men are afraid of the light”.

Keep America(ns) Safe

Keep America Safe.

Protect us from the  (fill in the blank)… Muslims…Mexicans…terrorists…refugees…Syrians…

But never fill in the blank with “Other Americans”.

We hear this from candidates all the time. America is a dangerous place…for some. But not from Muslim terrorists or jihadists. The biggest threat to human life comes from our  fellow citizens. With guns. All kinds of guns. Easily obtained.

Forget about the few “mass killings” At churches . Or schools. They are simply a spike in the graph. The every day, under reported killing of people in the USA is the biggest tragedy not covered by the media. Or candidates.

Keep America Safe.

For some reason keeping Americans safe from other Americans is a very low priority, especially for the two GOP candidates. I give you Matthew 7:3 ” Why do you see the speck that is in your brother’s eye but ignore the log in your own?”. It is easier to point the finger at “the other” than admit to our own societal  and governmental failures.

Fact: On 9/11 a small group of  Muslim extremists, mostly from Saudi Arabia, flew planes into building that killed almost 3,000 Americans. The US government retaliated with a massive attack on Afghanistan and later Iraq. Americans wanted revenge and wanted to make sure that we would be safe. Keep America Safe became the mantra. Ever since then our legal institutions and domestic priorities  have taken second place to our military desires. Keep America Safe. 3,000 innocents killed.

Fact: Since 2002 over 200,000 American citizens have been murdered. (Not including suicides or accidents, which almost doubles the figures) Not by Muslim terrorists. Not by ISIS. Not by hordes of Mexicans or Guatemalans.  By fellow citizens. By other Americans with guns. 200,000 citizens murdered. . And this is not seen as a crisis worth talking about. By any of the candidates.

Fact: Since 2002 over 17,000,000 Americans have been victims of violent crimes. Murders, assaults, rapes. 17,000,000 Americans . That is  MORE THAN the entire population of Wyoming, Vermont, Alaska, North Dakota, South Dakota, Delaware, Montana, Rhode Island, New Hampshire, Maine, Hawaii, Idaho, West Virginia and Nebraska COMBINED. 17,000,000. And not a peep from the candidates.

Not worth mentioning.

These Keep America Safe politicians don’t seem to equate America with Americans. To them “America” is simply a land mass with a border, not millions of people. A geographic entity. Uninhabited? Children living in inner cities? Not Americans. The homeless? Not Americans. Battered spouses? Not Americans.

Perhaps someday a moderator in one of the debates will ask these candidates why they outline no plans to keep “Americans” safe. Wouldn’t that be a good question to ask?

Bernie Sanders seems to agree with President Obama’s current policies on ISIS and terror, in general.
